  • Our GoJoe application (“App” or “GoJoe App”), whether you access it by downloading the GoJoe App onto your mobile telephone or handheld device or by using the browser-based version of the App on any device (including via mobile or desktop browser), without downloading it;
  • The GoJoe Performance Hub, our web-based administration centre through which authorised administrators of client organisations configure their organisation’s area of the App and manage its content, benefits, challenges and gamified features, communications, community settings, users, data integrations, and reporting and analytics (“Performance Hub”); and
  • Any of the services accessible through the GoJoe App (howsoever accessed), the Performance Hub or our website at www.gojoe.com or any other sites of ours (“Website”).

References in this notice to the "App" or "GoJoe App" include the downloaded application and the browser-based version, and this notice applies in the same way whichever route you use to access our services.

This policy sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. Please read the following carefully to understand our practices regarding your personal data and how we will treat it.

Where personal information is received from your employer or other third party source which decides the purposes and means for processing your data, please note that these organisations will also continue to act as a controller in relation to the personal data shared with us. GoJoe may act as a controller and a processor at the same time in relation to different data: for example, we act as a processor of eligibility information provided to us by your organisation, and as a controller of the information you create through your own use of GoJoe. Where we act as a processor, the privacy notice of the relevant controller will also apply.

Our services

GoJoe provides the following modular services. Not all of them will apply to you: which services are available to you depends on the features and programmes your organisation has selected and enabled or, where you use GoJoe as an individual User, those you choose to use. Our services comprise:

  • challenges, programmes and community features supporting activity, health, wellbeing and engagement, for client organisations, their workforces and other eligible participants, and/or individual Users;
  • health, fitness and wellbeing content, and gamified features, streaks, points, scores, badges and leaderboards;
  • incentives and rewards programmes, under which Users may earn points and redeem them for incentives and rewards fulfilled by us or through our fulfilment partners;
  • wellbeing incentive administration for client organisations – tracking completion of qualifying health-related activities (verified via the organisation’s nominated benefit providers or self-attestation) and reporting completions so incentives can be applied;
  • benefits eligibility and navigation features, through which Users can view and access benefits and services made available by their organisation;
  • health assessments and questionnaires (such as health risk assessments), delivered by us or with our clinical partners where enabled by a client organisation, together with related insights and scores provided to the User;
  • where enabled by a client organisation, display to a User of their own health information (such as screening results), visible only to that User; and
  • the GoJoe App, the GoJoe Performance Hub and Website;

for the purposes of social fitness, health and wellness engagement, and the administration of client organisations’ wellbeing and health programmes.

Compliance with Data Protection Legislation:

All your personal Information will be held and used in accordance with the UK General Data Protection Regulation (“UK GDPR”), the Data Protection Act 2018, the EU General Data Protection Regulation where it applies to our processing, and any other legislation relating to the protection of personal data (“data protection laws”).

When you take part in GoJoe, use our services, GoJoe App, the GoJoe Performance Hub, and / or our website we collect the following:

Informations sur le compte

Some personal information is required to set up the GoJoe App and GoJoe Performance Hub including your name and an email address (“Mandatory Account Information”).

You may also choose to provide other information including additional contact details, a date of birth, your gender, a profile picture, height, weight, activity levels, posts, media such as photos/videos, your workplace or organization or other content that can be uploaded by you to our App (“Optional Account Information”). Users may elect to alter privacy settings from within the App, which affects the extent to which people can see a user's activities, content and stats.

If you have signed up via your workplace, we may also collect some limited employment details for your subscription, such as the name of your employer or organisation, your work email address, an employee identifier, your country or office location, or your team or department.

Workout and Activity Information

You can add workout and activity data to the GoJoe App in three ways: by syncing a wearable or connected app or platform (for example Apple Health, Health Connect, Garmin, Fitbit, HUAWEI Health, Oura, Whoop, Polar, Coros or Wahoo), by using the in-app GoJoe tracker, or by entering it manually. This data may include step counts; activity records such as activity type, distance, duration, speed and heart rate; recovery and sleep data where you choose to sync it (such as heart-rate variability, resting heart rate, and sleep duration and quality); and, where you use GPS-based tracking (through your wearable, a connected app or platform, or the in-app tracker), location data and route maps (together, "Workout and Activity Information"). Some of this information is health data - see "Health and other special categories of personal information" below for how we handle it.

You will be asked for specific consent before any Workout and Activity Information is shared with the GoJoe App from a wearable, app or platform - either in the GoJoe App (in your settings or when you first sync) or through the permission settings of the relevant device or platform - where you control exactly which data types are shared. You can withdraw your consent at any time by disconnecting the wearable, app or platform or adjusting your settings or device permissions; this stops further data being shared with us from that source.

Where you choose to activate and use our wellbeing insights features, and to sync the relevant data, we use your Workout and Activity Information to generate personal wellbeing insights and scores for you. We do not generate these insights and scores unless you elect to activate and use these features. For example, our wellbeing scores are built from your physiological recovery (trends in your heart-rate variability and resting heart rate), your sleep quality (duration, efficiency and sleep stages, relative to your personal need) and your recent training load. These insights and scores, and the heart rate data, recovery and sleep data used to create them, your health assessment and screening information and location data are visible only to you. They are not shared with other users, and they are not shared with your employer or any organisation that provides you with access to GoJoe, or with any other third party for their own purposes - our service providers process this data only on our instructions in order to deliver the service to you. Any reporting provided to your organisation is aggregated and does not include your individual scores, insights or health data.

Workout and Activity Information powers your experience in the GoJoe App: your activities appear on activity feeds and count towards challenges, including leaderboards. The information visible to other users relates to the activity itself and may include the activity type, distance, duration, pace, calories, steps and the points earned.

You can also set your profile to private at any time, which restricts the information visible about you on your profile - such as your name, activities, followers, photos and stats. Note that if you take part in a challenge, your participation is visible to other participants as part of that challenge (for example, your activities will appear in the challenge history and your points will count on leaderboards), even though they will no longer appear on your profile.

Some of the information we process is health data or another special category of personal data. We process this data only on the basis of your explicit consent. That consent is requested separately, at the point you take the action that leads to us receiving the data - whether that is within the GoJoe App (for example, when you enter data, grant device or platform permissions, start an assessment, or enrol in a programme) or as part of a process operated by your organisation or its provider (for example, a screening provider asking for your consent, when you register for or attend a screening, to share your results). You can withdraw your consent, and ask us to delete your data, at any time.

Depending on how you use GoJoe and which features your organisation has enabled, this data may include:

  • Workout and Activity Information that you sync or enter, including recovery and sleep data, as described above;
  • your responses to health assessments and questionnaires (such as health risk assessments) delivered by us or with our clinical partners, and the insights and scores derived from them;
  • wellbeing incentive information, where your organisation operates an incentive programme through GoJoe: self-attestations you make, and confirmations we receive from your organisation's nominated benefit providers that you have completed a qualifying health-related activity (for example a preventive care visit, health screening or programme participation);
  • your health screening results, where your organisation has enabled this feature: results we receive from its nominated screening provider so that we can display them to you; and
  • information about your use of health-related content and features (for example content you save or programmes you join), which may indicate information about your health or interests.

You can withdraw your consent at any time, and you can ask us to delete your data at any time (see "Your rights" below). If you withdraw consent, we will stop the related processing going forward - though this may mean some features no longer work for you (for example, we cannot track your incentive progress without processing your completion data). Withdrawal does not affect processing that took place while your consent was active, and where your consent was given to a provider, you can also withdraw it directly with that provider.

Beyond the completion status described in "Wellbeing incentive programmes" below, your individual health data is visible to you, not to other users, and any reporting provided to your organisation is aggregated and does not include your individual health data, screening results, assessment responses, insights or scores.

Wellbeing incentive programmes

Where your organisation operates a wellbeing incentive programme (including, where applicable, the organisation of the family member through which you have access to GoJoe) (for example, a reduction in medical plan contributions for completing a qualifying activity), we share with your organisation and/or its nominated providers (such as its benefits administrator or payroll provider) the fact that you have, or have not, completed a qualifying activity, so that your incentive can be applied. This is limited to your completion status: we do not share the underlying health information - such as your screening results, assessment responses or activity detail - with your organisation or its providers.

Incentives and rewards

Where you participate in an incentives or rewards programme, we process information about the points you earn and the rewards you choose and redeem. When you redeem a reward, we share the information needed to fulfil it - such as your name, email address and reward selection - with our fulfilment partners, who use it only to provide your reward.

In some programmes, the value of rewards you receive may be taxable. Where this applies, we may report the value of your redeemed rewards (and the information needed to attribute it to you) to your organisation and/or its payroll provider so that any tax can be handled correctly. This reporting is limited to the value and fact of your rewards: it does not include your underlying health information, and the activities that earned your points are not shared beyond the completion status described in "Wellbeing incentive programmes" above. GoJoe does not provide tax advice - the tax treatment of any rewards is a matter for your organisation and, where relevant, your own adviser.

If you enter a contest, prize draw or sweepstakes (whether entered directly or through entries earned by completing qualifying activities), we collect your entry details and use them to administer the promotion: recording your entries, selecting and notifying winners, and delivering prizes - which may involve sharing your name and delivery details with our fulfilment partners or, where the promotion is run with your organisation, with your organisation for prize delivery. Where the law of a promotion requires it, we may publish or make available a winners list limited to the minimum information required. Any additional terms for a specific promotion will be made available when you enter.

Contacting us, surveys and promotions

If you contact us (for example through in-app support or by email), we collect the information you submit - such as your name, contact information and your message - and use it to respond to you and resolve your query.

If you take part in a survey, we collect your responses and use them to understand how our services are used and how they can be improved. Survey participation is voluntary, and results are typically analysed on an aggregated basis.

Together with the entry details you provide for contests, prize draws and sweepstakes (see “Incentives and rewards” above), this is your “Contact, Survey and Promotion Information”.

Communications we send you

We send four types of communications, depending on how you use GoJoe:

Service messages. Messages about your account, its security and important changes to our services or this notice. We need to send these while you have an account, so you cannot opt out of them.

Activity and social notifications. Notifications about your activity and your interactions with other users - for example when an activity you log is recorded, when someone you follow or are in a group with posts, comments or reacts, or when there is activity in your teams, clubs or challenges. You can manage these in your notification settings, where you can turn push notifications on or off and, where they are on, choose the categories you receive: general, activity, social, challenge and organisation notifications.

Programme communications. Where you access GoJoe through your organisation: joining instructions, challenge invitations, updates and reminders, reward and completion confirmations and similar messages about your organisation's programme. Some programme communications are sent on behalf of, or at the instruction of, your organisation. You can manage many of these through the same notification settings described above.

Marketing. News, offers and information about GoJoe features and services beyond your programme. We will only send you marketing where you have opted in to receive it, and you can opt out at any time using the unsubscribe link in any message, through your account settings or by emailing privacy@gojoe.com. If you use GoJoe through your organisation, we will only send you service and programme communications unless you separately opt in to marketing. We keep a record of your marketing preferences and notification settings - whether you have opted in to or out of marketing communications and which notification categories you have enabled (your “Marketing and Communications Information”) - so that we can respect your choices.

We do not share your Contact, Survey and Promotion Information or your Marketing and Communications Information with third parties for their own marketing purposes.

Aggregated data

Across all of the information described in this privacy policy, we also collect, create, use and share aggregated data, such as statistical or demographic data. Aggregated data may be derived from your personal data - including your Workout and Activity Information and the health data described above - but is not considered personal data in law, as it does not directly or indirectly reveal your identity. For example, we may aggregate activity within the GoJoe App or the GoJoe Performance Hub to calculate the percentage of users accessing a specific App feature, or to provide your organisation with aggregated participation and engagement reporting. However, if we combine or connect aggregated data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data and use it in accordance with this privacy policy.

Children

Our services are not directed at children under 16 and we do not knowingly collect their personal data; contact privacy@gojoe.com if you believe a child has provided us with data.

This section applies where you are able to make orders via our App or Website. We may process your personal information to process any orders that you make by using our websites, and / or GoJoe App. Payments are processed securely by our payment provider, and we do not store your full card details. The information processed may include your name and the payment details required to process your order (“Payment Information”).

Device and Usage Information

When your device syncs with the GoJoe App or our software, data may be transferred from your device. This information is used to improve your experience and enable you participate in the GoJoe App and features including GoJoe Challenges. We may also process information such as your browser type, settings and information about how and when you used our service, information about the type of device and/or operating system you are using, which videos you have watched, what content you like or share (“Device and Usage Information”).

Where you access GoJoe through a workplace, sponsor or partner organisation, that organisation - or its benefits administrator or HR system - may provide us with personal information so that we can give you access to GoJoe and administer its programme. This may include your name and contact details, an employee or membership identifier, your work location, and the benefit plans, programmes or features you are eligible for or enrolled in. We use this information to set up and manage your access, invite you to join your organisation’s area of the App and its challenges and programmes, tailor the benefits and features shown to you, administer your organisation’s programmes, and send you the programme communications described in “Communications we send you” above. GoJoe will not disclose any other personal information in such communications.

You may choose to create your account or sign in using Facebook, Google or Apple. If you do, we receive standard account information from that provider - such as your name, email address and profile photo - which we use to create and operate your account; what is shared is made clear to you at the point of sign-in. If you access GoJoe through your organisation, you may also be able to sign in using your organisation’s single sign-on service; where you do, your organisation confirms your identity to us so that we can sign you in. All this information will be removed upon your account being deleted.  

We may also receive personal data about you from other third party sources as set out in this privacy policy, where you have given your consent. This may include health data:

  • Suppliers of diagnostic services such as third party providers of screening or test results. The results of the screening or test result should only be shared with us where you have given your consent to the third party provider.
  • Workplace benefits providers which are linked to your employer.
  • Healthcare related organisations and providers, including wellness and mental health providers. These providers are independent to us and act as separate controllers of the personal data. We may receive wellness assessment outcomes from these providers.

If you have given your consent to receive marketing emails you can withdraw this at any time. Just let us know. If you have received a direct marketing email from us and no longer wish to do so, the easiest way to let us know is to click on any unsubscribe link at the bottom of our marketing emails or to reply to the email with the word “unsubscribe”.

In certain circumstances, we need your personal data to comply with our contractual obligations or to pursue our legitimate interests in a way which might be reasonably expected as part of our running our business. For example, in order to deliver the services to you, we need to use the information you provide us to enable your participation in the GoJoe App including your organisation’s community area and activated features within it. We may also use your information to help you find and connect with a workplace challenge and achieve a healthier lifestyle.

We also use your information when we need to contact you about GoJoe including a GoJoe Challenge, about your GoJoe organisation or in order to respond to you if you contact us.

There are special rules about how we can use your health related information. For health related information, in addition to the lawful bases outlined above, we must also comply with an Article 9 UK GDPR condition. In the table below we have set out the conditions that we rely upon when processing health data.

Beyond the in-app activity visibility and the completion status and reward reporting described above, we never share your health data or wearable data in an identifiable form with your organisation, its sponsors or its providers.

  • authentication and sign-in;
  • email automation services including service emails and push notifications;
  • technology companies who help us deliver features or support including in-App help and chat and customer support;

  • mapping services for route and location features;
  • reward fulfilment; and
  • internal administration tooling.

We maintain an up-to-date list of the sub-processors and sub-contractors we use, including the locations in which they process personal data, which is available on request by emailing privacy@gojoe.com.

Where your organisation’s programme includes additional services (such as health assessments, screenings or expert-led content), these are delivered with specialist clinical, screening and content partners engaged for that programme, and details of the partners relevant to your organisation’s programme are available from us on request.

We only provide third parties with the information they need to know to perform their specific services. We work closely with all the third parties to ensure that your personal data is secure and protected at all times. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions. Our contracts with third parties make it clear that they must hold information securely, abide by the principles and provisions of data protection, and only use information as we instruct them to.

Where your personal information may be processed:

Your personal information is processed primarily in the UK and the European Economic Area: GoJoe's core application data is hosted by Amazon Web Services in Dublin, Ireland. Some of our service providers process personal data in other countries, including the United States, and we also engage specialist individual contractors, including live chat support agents based in the Philippines. The locations in which our sub-processors process personal data are set out in the sub-processor list referred to above, available on request from privacy@gojoe.com.

Where your personal information is transferred outside the UK or the European Economic Area, we ensure it receives an equivalent level of protection by making sure one of the following safeguards is in place:

  • A UK adequacy decision or, where EU law applies, a European Commission adequacy decision covering the destination country, including transfers to organisations certified under the UK Extension to the EU-US Data Privacy Framework or the EU-US Data Privacy Framework; or
  • Appropriate safeguards under Article 46 UK GDPR or EU GDPR, such as the International Data Transfer Agreement approved by the ICO, or the UK Addendum to the EU Standard Contractual Clauses and the EU Standard Contractual Clauses, supported by a transfer risk assessment.

The Health Insurance Portability and Accountability Act of 1996 ("HIPAA") is a U.S. federal law that applies to Protected Health Information (“PHI”).

Where part of the services we provide, GoJoe may receive, create, maintain, use or disclose Protected Health Information ("PHI") on behalf of “Covered Entities” such as healthcare providers, health plans, workplace wellness programmes. In such cases GoJoe acts as a “Business Associate” and processes PHI in accordance with applicable Business Associate Agreements and HIPAA requirements.

We may receive PHI including health screening results, biometric measurements, wellness assessment outcomes, activity and fitness information and other health-related information authorised by you or disclosed by permitted third-party providers. We use such information solely for providing the services, administering wellness programmes, performing services on behalf of Covered Entities and other purposes permitted or required by HIPAA and applicable law.

We maintain administrative, technical and physical safeguards designed to ensure the confidentiality, integrity and availability of PHI. Subcontractors that handle PHI on our behalf are subject to appropriate contractual protections.
